The complaint
Texco, Inc. v. Ivy May, Inc., No. 2:26-cv-12909 (C.D. Cal.), was filed November 3, 2026, ECF No. 1, with a jury demand. Texco, Inc. is described as a California corporation in Los Angeles. The defendants are Ivy May, Inc. and In Loom, Inc., described on information and belief as California corporations and women's apparel wholesalers; Four Lilies, LLC d/b/a Baltic Born, described on information and belief as a Utah limited liability company; Peppamayo, described on information and belief as a Florida business entity of unknown form; Boho Luv Boutique, described on information and belief as a New Jersey entity of unknown form; and Does 1 through 10, described as unknown manufacturers, printers, converters, importers, and vendors in the chain of distribution.
The works
The complaint says Texco's in-house design team created, and Texco exclusively owns, Design Nos. P-603, P-83, and P-614. It says P-603 and P-614 are registered under Registration No. VAu 1-335-462, effective August 2018, and P-83 under Registration No. VA 2-140-533, effective January 2019, that each certificate identifies Texco as the author of the designs, which were created as works made for hire, and that the claimant named on the VAu 1-335-462 certificate, an individual, assigned all interest in the designs registered there to Texco in writing shortly after that registration issued. It says Texco completed P-83 in 2017 and first published it in February 2017. It describes P-603 as a vertical floral of stylized lily blossoms and P-83 and P-614 as vertical florals of meandering stems with open-faced blossoms, with P-614 a derivative of P-83.
The Copyright Office records show Registration No. VAu 1-335-462 as an unpublished collection titled "PRINTS BY TEXCO 8-21-18," registered August 21, 2018, and Registration No. VA 2-140-533 as "PRINTS BY TEXCO P-83," registered January 9, 2019, with a first publication date of February 21, 2017. Both records list Texco Inc. as author of the 2-D artwork as employer for hire. The VA 2-140-533 record lists Texco Inc. as claimant; the VAu 1-335-462 record lists an individual as claimant.
What the complaint alleges
The complaint alleges, on information and belief, that Ivy May imported or caused to be manufactured finished garments bearing the Subject Designs and sold them to retailers, including the Aurora Velvet Maxi Dress (P-603) and, in the alternative to DOE 1, the Penelope Velvet Maxi Dress (P-614) to Baltic Born, a velvet maxi dress bearing P-614 to Peppamayo, and In Loom style ILD5923-1 bearing P-603 to In Loom. It alleges Baltic Born sold the Penelope, Leslie, and Aurora dresses through balticborn.com; Peppamayo sold a velvet maxi dress bearing P-614 through peppamayo.com; In Loom sold style ILD5923-1 to retailers under its own label; and Boho Luv sold that In Loom Dress through boholuv.com and its retail stores. It says Ivy May is identified on the Aurora Dress by its Registered Identification Number. It alleges the accused products copy the Subject Designs' blossoms, leaves, stems, scale, and placement, and that the similarity is so striking that it can be explained only by copying.
The complaint says Texco notified Baltic Born in writing that the Penelope Dress infringed P-614 in August 2025, and later notified it of the Leslie Dress in January 2026 and of the Aurora Dress in June 2026, and that efforts to resolve the dispute were unsuccessful. It says Texco notified In Loom and Boho Luv in writing in June 2026 that the In Loom Dress infringed P-603. It alleges each defendant's infringement was willful or, at a minimum, in reckless disregard of Texco's rights.
