The work

The complaint alleges that a songwriter under contract with Mattie co-wrote Just the Two of Us, that by that contract Mattie is a copyright proprietor of the composition, and that it is registered as PA0000102060, dated April 1, 1981. The Copyright Office record lists Bleunig Music as claimant. The complaint says a 1981 single recording of the song reached number 2 on the Billboard Hot 100 and won a Grammy Award. (Compl. paras. 10 to 11.)

What the complaint alleges

It alleges Capitol released the album The Art of Loving on or about September 26, 2025, including the composition I've Seen It, and that in August 2026 Mattie's representatives concluded, and a musicologist it retained found in a preliminary comparison, that I've Seen It copies protectable expression in Just the Two of Us, including its melody. It alleges, on information and belief, that Universal Music Group, Kobalt, and Sony were involved in exploiting the accused composition, and it alleges Mattie sent written notice to each defendant on or about August 17, 2026. (Compl. paras. 12 to 17.)

Claim and relief

The single claim alleges copyright infringement under 17 U.S.C. 501 against all defendants. It alleges, on information and belief, that Capitol and Universal Music Group distributed and exploited sound recordings of the accused composition, that Sony and Kobalt licensed and exploited its publishing rights, and that the infringement was willful. The prayer seeks a permanent injunction, damages and profits, interest, costs, statutory damages of up to $150,000 for willful infringement, and fees under 17 U.S.C. 505.
