The complaint

Eddie Malluk v. RockerosVIP LLC, No. 2:26-cv-06691 (D. Ariz.), was filed September 18, 2026, ECF No. 1 (13 pages). Malluk, a New York photographer, demands a jury trial. The docket shows the case is assigned to Judge John J. Tuchi.

The work

Malluk alleges he created a photograph of Sebastian Bach, the Canadian singer known as the frontman of Skid Row, and that the Copyright Office registered it on December 16, 2015, under Registration No. VAu 1-239-882. The Copyright Office public record lists that registration as an unpublished collection with Malluk as author and claimant.

What the complaint alleges

Malluk alleges that RockerosVIP, an Arizona company, owns and operates social media accounts on Facebook, Instagram, and X, and that it reproduced and displayed the photograph in posts on or about April 4, 2018, and April 3, 2020, five posts in all, without permission. He alleges, on information and belief, that the accounts are part of RockerosVIP's commercial enterprise and that the company knew or should have known the photograph was protected. The single cause of action pleads copyright infringement and seeks actual damages and profits or, at Malluk's election, statutory damages, plus fees and costs.

On the docket

The court entered orders on September 21, 2026, and a pro hac vice remark appears on September 25, 2026. No response from RockerosVIP appears on the docket through October 30, 2026.
