The complaint
Image Professionals GmbH d/b/a StockFood v. Thai Singha House, Inc., No. 2:26-cv-08452 (E.D. Pa.), was filed November 4, 2026, ECF No. 1. The plaintiff is a German company based in Munich that licenses food images through its StockFood website. The defendant is a Pennsylvania corporation that the complaint says operates a restaurant in Philadelphia.
The work
The work is a photograph of a bowl of coconut soup with chicken and coriander leaves, titled "00261334," created by one of StockFood's contributor photographers. The complaint says the photograph was registered by StockFood America, Inc., then a wholly owned subsidiary, which in November 2020 assigned its copyrighted materials and registrations to the plaintiff, and that written agreements with the photographer convey exclusive rights to the plaintiff. It identifies the registration number in Exhibit A and the certificate in Exhibit B; those exhibits are not available.
The alleged infringement
The complaint alleges the restaurant displayed the photograph on its website, social media, or other advertising after registration, alleges, on information and belief, that it copied the photograph from the internet, and says StockFood discovered the use in January 2025 and notified the defendant in writing.
The claim and relief
Count I pleads copyright infringement under 17 U.S.C. § 501 and alleges willfulness. The prayer seeks declarations of infringement and willfulness, actual damages and profits or, at the plaintiff's election, statutory damages for each photograph, costs and attorney's fees under § 505, interest, a permanent injunction, and other relief.
Docket
The docket shows the complaint, a Rule 7.1 disclosure statement, a magistrate judge consent notice, and a court-annexed mediation notice.
