The complaint
Great Bowery, Inc. d/b/a Trunk Archive v. Sabina Brailovskaya, an individual, d/b/a Unique Boutique and Does 1 through 10, No. 1:26-cv-14401 (D. Mass.), was filed September 25, 2026 (10 pages). Trunk Archive is a Delaware corporation based in New York that describes itself as a photography licensing agency. The complaint alleges, upon information and belief, that Brailovskaya does business in Newton Centre, Massachusetts as a medical spa under the trade name Unique Boutique. Trunk Archive demands a jury trial. A docket entry the same day assigns the case to Chief District Judge Denise J. Casper. (Compl. caption; paras. 5 to 6, 9, 21 to 22; ECF No. 5.)
The work
The complaint alleges that a photographer it represents is the sole author of a close-up beauty photograph of a model posing with tropical foliage, registered as VA 2-229-926 with an effective date of October 29, 2020, and that he granted Trunk Archive the exclusive right to license it. The Copyright Office public record for VA 2-229-926 lists a group registration of published photographs from 2014 and a registration date of October 19, 2020. (Compl. paras. 16 to 20; Copyright Office record.)
What it alleges
The complaint alleges that the defendant manages and controls the spa's website, that on or about March 3, 2026 Trunk Archive found the photograph on the homepage next to a description of the business, that it never licensed the use, and that the parties could not resolve the matter before suit. It alleges, on information and belief, that the infringement was willful. (Compl. paras. 23 to 26, 34 to 35.)
The count and relief
The single count pleads copyright infringement under 17 U.S.C. 101 et seq. The prayer asks for a finding of infringement, actual damages and profits or, at Trunk Archive's election, statutory damages, an injunction under 17 U.S.C. 502, costs and fees, and interest. (Compl. paras. 33 to 37; Prayer.)
