The complaint

Corson v. Tin & Gin LLC d/b/a haley.henry wine bar et al., No. 1:26-cv-14233-PBS (D. Mass., Eastern Division), was filed September 15, 2026, ECF No. 1 (10 pages). Corson sues Tin & Gin LLC d/b/a haley.henry wine bar and Haley Fortier for direct and vicarious copyright infringement and demands a jury trial. A docket entry assigns the case to Judge Patti B. Saris.

The work

Corson, a freelance photographer, alleges she is the sole author of a photograph of colorful tins in a display at a sardine shop in Times Square, New York, registered under Registration Number VA 2-376-401 with an effective date of November 20, 2023. The Copyright Office public record lists that number as a group registration of published photographs. She alleges the photograph ran with her photo credit in an October 10, 2023 newspaper article about tinned fish that featured the wine bar.

What the lawsuit alleges

Corson alleges, on information and belief, that Fortier is the principal owner of Tin & Gin and that the defendants operate the wine bar's website. She alleges that on or about May 4 she found the photograph on the website with "tinned fish is trendy" text over it and a link to the article, that the defendants removed it after receiving her cease-and-desist email in May 2026, and that as of August 28, 2026 a copy remained stored on the website's server. She seeks damages and injunctive relief.
