What it alleges
Chadwick alleges he owns an original photograph registered with the Copyright Office. The complaint describes California Brain & Spine Center, on information and belief, as a California corporation based in Calabasas, and alleges that it controls the californiabrainspine.com website and related social media pages, including an Instagram account, and used the photograph there for commercial purposes without authorization. It alleges, on information and belief, that the defendants had access to the photograph and that the infringement was willful. The single claim pleads copyright infringement.
Chadwick seeks an injunction, the defendants' profits and his losses or, at his election, statutory damages under 17 U.S.C. § 504, fees under 17 U.S.C. § 505, interest, and costs.
