The complaint

Bedard v. Walmart Inc. and Wal-Mart.com USA LLC, No. 9:26-cv-81212 (S.D. Fla., West Palm Beach Division), was entered on the docket September 22, 2026 (11 pages). Bedard lives in Palm Beach County, Florida. Walmart Inc. is a Delaware corporation and Wal-Mart.com USA LLC a California limited liability company. Bedard demands a jury trial. A clerk's notice the same day assigns the case to Judge Aileen M. Cannon. (Compl. caption; paras. 7 to 9; ECF No. 2.)

The work

The complaint alleges that in 1974 Bedard created a pictorial illustration titled U.S.A. Flag-Map, that it was registered with the Copyright Office as Registration Number K 110045, and that since 1974 he has used it on invoices, labels, roofing material, decals, and bumper stickers sold across the United States. (Compl. paras. 12 to 16.)

What it alleges

The complaint alleges that in about 2026 the defendants placed the illustration on products sold in Walmart stores and on walmart.com, that the products are substantially similar to or nearly identical with the protectable elements of his work, and that Bedard discovered the use in January 2026. It alleges the defendants refused to stop after notice and, upon information and belief, that the infringement was willful or in reckless disregard of his rights. (Compl. paras. 19 to 28, 37.)

The count and relief

The single claim pleads copyright infringement under 17 U.S.C. 106 and 501. The prayer asks for a finding of infringement, actual damages and profits or statutory damages including enhanced damages for willful infringement, a permanent injunction, impoundment under 17 U.S.C. 503, an accounting, fees and costs, and interest. (Compl. paras. 29 to 42; Prayer A to H.)
